Welcome to Gyanmokshaa, where we provide exceptional design and digital marketing services. By engaging with our services, you agree to the following terms and conditions. Please read them carefully.
1. Agreement
By placing an order with Gyanmokshaa, you agree to be bound by these Terms and Conditions. These terms govern the relationship between you (the "Client") and Gyanmokshaa (the "Company"), founded by Suchandra Das, regarding all services provided.
2. Service Delivery
Scope of Work: The details of the project scope, deliverables, and timelines will be outlined in a written agreement or project brief. Any additional requests or changes beyond the agreed scope may incur extra charges.
Timelines: While we strive to meet all deadlines, Gyanmokshaa is not liable for delays caused by factors beyond our control, including but not limited to client delays, unforeseen technical issues, or third-party service disruptions.
3. Payment Terms
Deposits: A non-refundable deposit of varying percentages is required to commence any project. The balance is due upon project completion or as outlined in the payment schedule. The details of the deposit shall be shared in the payment plan.
Payment Methods: Payments can be made via GPay, PhonePe, or Payment Gateway on our website. Gyanmokshaa reserves the right to suspend work if payments are not received as per the agreed terms.
4. Revisions and Changes
Logo and Design Revisions: The number of revisions included is based on the chosen package. Additional revisions beyond the agreed number may incur extra charges.
Project Scope Changes: Any changes to the project scope after work has commenced may result in additional charges and may affect the project timeline.
5. Intellectual Property
Ownership: Upon full payment, the Client will own the final design and associated files. However, Gyanmokshaa retains the right to showcase the work in portfolios, case studies, or promotional materials.
Usage Rights: The Client may use the delivered work for the agreed-upon purposes. Any additional use or modification of the work beyond the original scope must be approved by Gyanmokshaa.
6. Confidentiality
Client Information: Gyanmokshaa will handle all client information with strict confidentiality and will not disclose it to third parties without prior consent, except as required by law.
Project Details: Any proprietary or sensitive information shared during the project will be kept confidential and used solely for the purpose of completing the project.
7. Cancellation and Termination
Client Cancellation: The Client may cancel a project by providing written notice. Refunds will be processed as per the Cancellation & Refund Policy. The Client remains responsible for any work completed up to the cancellation date.
Company Termination: Gyanmokshaa reserves the right to terminate any project if the Client fails to meet agreed obligations, including payment and timely communication. No refunds will be issued in such cases.
8. Limitation of Liability
Gyanmokshaa is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our liability is limited to the amount paid by the Client for the specific project in question.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the land. Any disputes arising from these terms shall be resolved through mediation or arbitration, as appropriate.
10. Amendments
Gyanmokshaa reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to the Client and will apply to all future projects and services.
